What is a Visual Impact Assessment, and when does the Niagara Escarpment Commission require one?

If you are planning a project anywhere in the Niagara Escarpment Plan Area, there is a reasonable chance someone has told you that you need a Visual Impact Assessment. It is not a marketing document, it is not the same thing as a rendering, and the first time most people hear the term is when a planner or a regulator asks for one.
Here is what it actually is, what goes into it, and where the visual work fits.
The short version
A Visual Impact Assessment, usually shortened to VIA, answers one question for the approving authority: what will this look like from the surrounding landscape once it is built, and is that change acceptable?
It answers that question with evidence rather than impressions. Photographs taken from specific, recorded positions in the landscape. An accurate three-dimensional model of the proposal. The two combined, so a reviewer can see the proposed building or structure sitting in a real photograph of the real place. Then an analysis of how visible the proposal is and how it affects the scenic resources, measured against the Plan's policies, with measures to reduce any impacts.
Why the Escarpment in particular
The Niagara Escarpment Plan was Canada's first large-scale environmental land use plan. It covers about 195,000 hectares across portions of more than 20 local municipalities in seven regions and counties, plus the City of Hamilton, and sets out land use designations, development criteria and permitted uses. Its purpose is to maintain the Escarpment and land in its vicinity substantially as a continuous natural environment, and to allow only development that is compatible with it.
Maintaining the open landscape character of the Escarpment is one of the Plan's objectives, so how a development looks from the surrounding landscape is a planning matter, not just an aesthetic preference. The Plan uses scenic rankings derived from a landscape evaluation study, running from Outstanding through Very Attractive, Attractive, Average, Low and Very Low. It defines scenic resources as the general appearance of a place or landscape, or the features of a landscape, taking into account visual condition and scenic quality, which vary by location and depend on features such as geology, vegetation, landforms and human development.
In other words, the visual question is written into the policy framework, so the assessment of it has to be documented.
When one gets asked for
There is no single trigger. The Niagara Escarpment Commission decides case by case, and a VIA can be required wherever a proposal's visual impact on the Escarpment's scenic resources is a concern. The request can come from Commission staff, from another agency such as the local municipality, or from the applicant.
The Commission's pre-consultation process for new Plan amendment and Development Permit applications, approved in March 2022, sets out what a complete application needs to contain. Pre-consultation isn't mandatory, but it is where you find out whether a VIA is on your list, and skipping it can slow things down later.
If a VIA is on the list, there is a second step that catches people out. The Commission's technical criteria for VIAs, approved in November 2020, require you to prepare a project-specific Terms of Reference and get the Commission's approval of it before any assessment work begins. It names who is doing the study and their expertise, describes the project, sets the study area (a five kilometre radius suits most applications, larger where long-range views are possible), and lists the methods, software and camera equipment. Staff may recommend a staged approach. Doing the work first and seeking agreement afterwards is how a VIA turns into two VIAs.
What is inside one
The approved Terms of Reference sets the scope, and not every method is needed for every study. The criteria describe the work in four parts.
1. Existing conditions and viewpoints
Every VIA addresses views from public roads, public lands and the Bruce Trail. Public lands include waterways such as Georgian Bay and Lake Ontario. Views from private property are not required for the Commission, though other agencies may ask for them.
Viewpoints are either pre-selected by Commission staff or identified from digital visibility mapping, then checked in the field, including the ones where the proposal turns out not to be visible. Each is a fixed point chosen to show the worst case for visibility, and one representative viewpoint can stand in for a stretch of road or trail with similar views.
2. Photography
The criteria are specific:
- A DSLR or SLR camera with a lens setting between 35mm and 55mm, the range accepted as closest to what the human eye sees
- Taken from the average viewing height of 1.5 to 1.8 metres above ground
- The whole view captured, with overlapping frames stitched into a panorama where needed, at a minimum overlap of 30 to 50 percent; phone panorama mode isn't accepted
- Worst-case conditions, such as leaf-off for deciduous trees, ideally in late fall, winter or early spring
- High resolution, legible when printed large; Google Street View and similar street-level images don't meet the standard
Leaf-off matters because summer foliage hides things that winter does not, and the assessment is supposed to show the harder case. As one example of how a project puts this into practice, a public work plan in Niagara Region specified leaf-off panoramas taken with a fixed 50mm lens from pre-determined receptor points.
3. The proposed change
A digital model is built from the most current plans, including everything that adds to the height, such as mechanical penthouses and rooftop features. For selected viewpoints, it is rendered into the base photograph and positioned using fixed locations, so scale, position and elevation are correct.
The base photo can be edited to remove features that are proposed for removal, but nothing else can be improved: no enhanced vegetation, no flattering adjustments. Proposed planting is shown at planting size, not at maturity.
Depending on the site, the study can also call for line-of-sight cross sections, visibility and viewshed maps, and field tests using cranes or balloons to confirm what can be seen through dense vegetation or at long distances.
4. The assessment and mitigation
For each viewpoint, the assessment records how visible the proposal is, analyses its effect on scenic resources, landscape character and scenic quality, and measures it against the Plan's policies and the scenic ranking of the landscape.
Viewer height, position and distance all count. The foreground runs to roughly two kilometres, but structures that break the skyline can register as distinct features even beyond that. The viewer is treated as stationary and looking toward the development, so how fast or briefly someone passes a view is not a factor.
Where impacts are found, the VIA describes how they will be reduced, with design drawings and, where required, cross sections or simulations showing the mitigation.
The submission itself is a written report with maps and drawings to scale, including a bar scale and a north arrow, in a non-proprietary digital format plus two hard copies. Commission staff either accept the findings or they don't, and where there's no agreement, the Commission decides.
Who prepares it
The criteria say the study should be prepared by a registered landscape architect or another qualified professional with skills in landscape assessment, site analysis and visual impact assessment. That person is responsible for the whole study, including the photography and the simulations, and is named in the Terms of Reference.
In practice the work is often split. The qualified professional leads the study, sets the viewpoints and writes the assessment, and a visualization specialist working to their brief builds the model and produces the photo simulations. Those simulations have to be precise and checkable: the criteria ask for findings that are objective and replicable, so a reviewer should be able to stand where the camera stood and see the same thing.
That is a different discipline from marketing imagery, where the work is to make a building look its best. A verified view is not a nicer version of a rendering. Its value is that nothing about it is improved.
How it relates to the renderings you will need later
Most projects that need a VIA also need marketing or communications imagery at some point: for community engagement, for fundraising, for sales, for a board.
The useful thing is that the model built for the assessment is the same model those images come from. Once an accurate three-dimensional model of the proposal exists, and once the site has been photographed properly, producing the atmospheric renders and video a campaign needs is a much shorter exercise than starting from nothing.
Projects that treat these as two unrelated purchases usually pay for the same modelling twice. Projects that sequence them, approvals first and communications second, tend not to.

Contact the Niagara Escarpment Commission and go through pre-consultation. Ask directly whether a VIA is required for your application and what scope staff expect. Read the Commission's technical criteria before commissioning anyone, and get the Commission's approval of your Terms of Reference before the assessment work begins.
Then assemble the team: the qualified professional who will lead and author the assessment, and the visualization partner who will produce the views to their brief.
